Preamble

These Terms and Conditions (the “Terms”) govern access to and use of the website available at https://groupp.app (the “Website”), published by Groupp Europe SA.

The purpose of the Website is to present the Groupp mobile application, its features and innovations, to share company news, to enable visitors to contact Groupp via a dedicated form, and, in due course, to communicate about events organized or supported by Groupp.

These Terms do not govern use of the Groupp mobile application itself, which is subject to separate Terms and Conditions of Use, available at https://legal.groupp.app/FR/cgu.html.

Access to and browsing of the Website constitute full and unreserved acceptance of these Terms by any visitor (the “User”).

Article 1 – Definitions

Website: the website https://groupp.app as a whole, including its sub-pages and content.

Publisher / Group: Groupp Europe SA, whose full identification details appear in the Legal Notice.

User : any natural person consulting or using the Website, regardless of their capacity.

Contents: all elements comprising the Website (text, images, videos, graphics, logos, sounds, etc.).

App / Group app: the Groupp mobile application, distinct from this Website, which is subject to its own terms of use.

The terms “personal data”, “processing”, “controller” and “processor” have the meaning given to them by Regulation (EU) 2016/679 of 27 April 2016 (the “GDPR”).

Article 2 – Access to the Website

The Website is, in principle, accessible 24/7, subject to interruptions necessary for maintenance or resulting from force majeure, an internet network failure, or any other event beyond Groupp's reasonable control.

Groupp implements reasonable means to ensure access to and the proper functioning of the Website, without any obligation of result. Groupp cannot be held liable for any inability to access, or any malfunction of, the Website linked to the internet network, the User's equipment, or any event beyond its control.

Article 3 – Website Content and Updates

The information published on the Website (presentation of the Application, its features, news) is provided for information purposes only and is subject to change without notice. Groupp strives to ensure the accuracy and timeliness of the information published, without guaranteeing the absence of errors or omissions.

Article 4 – Contact form

The Website offers a form enabling any User to send a request to Groupp. Personal data collected through this form is processed in accordance with the Website's Privacy Policy.

Article 5 – Events

Groupp may organize, co-organize or promote events (the “Events”), some of which may be announced or featured on the Website.

Registration for, or participation in, an Event, whatever the channel used to register (Website, partner platform, direct invitation, etc.), may be subject to specific General Terms of Sale (in particular where the Event is paid) and/or to Specific Participation Terms applicable to that Event. These specific terms, distinct from these Terms, are brought to the participant's attention and must be accepted by the participant before taking part. They set out, in particular, the registration procedures, the cancellation and refund terms where applicable, the applicable safety and participation rules, the applicable liability provisions, as well as the provisions relating to image rights and to the processing of personal data specific to the Event concerned.

For information purposes, photographs and/or videos may be taken during Events and published on the Website (in particular as part of dedicated albums), as well as on Groupp's social media and communication channels. The arrangements for informing participants, and the means available to object to such recording or request its removal, are set out in the Specific Participation Terms for each Event and, where applicable, in the Website's Privacy Policy.

Article 6 – Intellectual property

The Website, its structure, and all Content comprising it (text, images, graphics, logos, videos, icons, sounds, trademarks) are protected by intellectual property law and belong to Groupp or are used with the authorization of their respective rights holders.

Any reproduction, representation, modification, publication or adaptation of all or part of the Website's Content, by any means whatsoever, is prohibited without Groupp's prior written authorization, subject to the exceptions provided for by law (in particular short quotations).

Article 7 – Hyperlinks

The Website may contain links to other websites published by Groupp Europe SA, in particular the website groupp.eu dedicated to investors, as well as to third-party websites (in particular the Apple App Store and Google Play stores). Groupp exercises no control over such third-party websites and disclaims all liability for their content.

Article 8 – Cookies

The Website uses cookies and similar technologies. The arrangements for using these cookies, and the means available to the User to configure their choices, are described in the Website's Cookie Policy.

Article 9 – Personal data

The processing of personal data of Website Users is described in detail in the Website's Privacy Policy, which forms an integral part of these Terms.

Article 10 – Limitation of liability

Groupp cannot be held liable for direct or indirect damages resulting from use of the Website, except in the case of intentional misconduct or gross negligence on its part, and within the limits permitted by Belgian law.

These Terms may be amended by Groupp at any time, in particular to reflect changes to the Website or to applicable regulations. The version in force is the one published on the Website on the date of consultation.

Article 12 – Governing Law and Jurisdiction

These Terms are governed by Belgian law. Any dispute relating to their interpretation or performance shall fall within the exclusive jurisdiction of the courts of the judicial district of Brussels, subject to any mandatory consumer protection rules that may apply.
